By making any payment to or booking with Roads & Kingdoms Media, Inc. (“R&K”), you (“traveler”) agree to these Terms. These Terms contain liability waivers, a class action waiver, and a one-year limitation on claims. Group leaders and travel agents are responsible for sharing these Terms with all members of their group.
BOOKING & PAYMENT
Booking is confirmed upon a deposit (typically 50% unless otherwise noted) and completed traveler information. The remaining balance is due 60 days before departure. All deposits and payments are NON-REFUNDABLE unless stated otherwise. International airfare is NOT included; internal flights listed on the trip itinerary are included, and airport transfers are only included on the specific days the trip starts and ends. Do not book flights until written confirmation is received. Tours are sold as complete packages — itemized cost breakdowns are not provided. You must review all documents within 24 hours of receipt and report any errors immediately.
CANCELLATIONS & CHANGES
By traveler: Cancellation must be submitted in writing. A $1,500 administrative fee applies to all cancellations. If a replacement traveler is found, the fee may be waived at R&K’s discretion. No refunds are issued for unused services, early departures, or missed activities.
By R&K: R&K reserves the right to cancel any trip due to insufficient enrollment, safety concerns, or force majeure. In such cases, travelers will receive a full refund of all amounts paid to R&K. R&K is not responsible for any non-refundable travel expenses incurred by the traveler.
FORCE MAJEURE
R&K is not liable for cancellations, delays, or alterations caused by events beyond its control, including but not limited to: acts of God, war, terrorism, civil unrest, pandemics (including COVID-19), government actions, natural disasters, or strikes. In such cases, R&K will make reasonable efforts to offer alternative arrangements or credits, but no refunds are guaranteed.
LIABILITY & RISK WAIVER
Travel involves inherent risks. Traveler voluntarily assumes all risks of travel, including injury, illness, or death, and hereby releases and holds harmless R&K and its Representatives from all related claims, including third-party negligence. Traveler also agrees to indemnify R&K for any costs, damages, or legal fees arising from traveler’s breach, negligence, or conduct.
R&K is not responsible for the acts or omissions of third-party suppliers (hotels, airlines, guides, etc.) and makes no warranties regarding their services. R&K reserves the right to remove any traveler whose conduct endangers others or disrupts the trip. No refund will be issued in such cases. Traveler is responsible for their own health, valid documentation (passport, visas, inoculations), baggage, and personal property at all times.
MEDIA & COMMUNICATIONS
Traveler grants R&K a royalty-free, perpetual license to use photographs and videos from the trip for marketing purposes. You consent to receive all notices and communications electronically.
LEGAL TERMS
Class Action Waiver: Claims may only be brought individually, not as part of a class action. R&K’s liability is limited to compensatory damages only — punitive damages are expressly waived.
Notice of Claim: Written notice of any claim must be submitted within 30 days of the trip or cancellation. Any suit must be filed within one (1) year of the incident. R&K’s maximum liability shall not exceed amounts paid to R&K.
Governing Law: These Terms are governed by the laws of the State of New York, with venue in Queens County, State of New York.
These Terms constitute the entire agreement between the parties and supersede all prior communications. R&K may update these Terms at any time; continued use of services constitutes acceptance.
